Digital Millennium Copyright Act Notice and Procedure

We respect the copyrights of artists, musicians, and intellectual property owners whose trending merchandise we sell, and we require our users and partners to do the same.

This page outlines our procedures for addressing alleged copyright infringement in compliance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, which is essential to our commitment to Trustworthiness and Authoritativeness.

1. 🚨 Notice of Infringement (DMCA Takedown Notice)

If you believe that any material or content on the Crackteeca website infringes upon any copyright that you own or control, you may submit a written notification of alleged infringement to our designated Copyright Agent (details below).

To be effective, the notification must include substantially the following:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., the URL or product page link).
  4. Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number ((315)597−4007), and an electronic mail address (service.crackteeca@gmail.com) at which the complaining party may be contacted.
  5. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

All DMCA notices should be directed to our designated agent, who is responsible for receiving notifications of claimed infringement.

3. 🚫 Takedown Procedure

Upon receiving a valid DMCA notice, Crackteeca will take prompt action, which may include removing or disabling access to the allegedly infringing material. We will also take reasonable steps to notify the party who posted the material so they can provide a counter-notification.

4. ↩️ Counter-Notice Procedure

If you believe your material that was removed or disabled is not infringing, or that you have the authorization from the copyright owner, the copyright owner’s agent, or pursuant to the law, you may send a counter-notice to our Designated Copyright Agent with the following information:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
  4. Your name, address, and telephone number.
  5. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which the address is located (or if your address is outside the United States, for any judicial district in which Crackteeca may be found), and that you will accept service of process from the person who provided the original notification of infringement or an agent of such person.

5. ♻️ Repeat Infringer Policy

In accordance with the DMCA and other applicable law, Crackteeca has adopted a policy of terminating, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers.
